Terms of Service
The rules for using apexflowrcm.com, including, plainly stated, why every number the free denial-cost check shows you is an estimate, not a measurement or a guarantee.
1. Acceptance of terms
By accessing or using apexflowrcm.com (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site. These Terms apply to your use of the Site itself; they do not replace a separate signed client services agreement, BAA, or contract between Apex Flow and a practice, which governs actual billing/recovery services.
2. What the site is (and isn't)
The Site is informational. It describes Apex Flow's denial-intelligence technology and revenue-cycle services, and offers a free, self-serve "Denial & A/R Exposure Check" tool and a way to request a free audit or book a call. The Site does not provide, and nothing on it should be relied upon as, medical advice, legal advice, or professional billing/coding advice for any specific claim, patient, or practice situation.
3. The free denial-cost check is an estimate, not a measurement or a guarantee
Read this before relying on any number the exposure-check tool shows you. The free "Denial & A/R Exposure Check" (and the companion calculator on our homepage) applies published third-party industry benchmarks (for example, denial-rate statistics from sources such as Experian Health's State of Claims report, cited on the tool itself) to the specialty and approximate billing volume you self-report in the tool. The resulting dollar figures and denial-code list are:
- an estimate derived from industry averages, not a measurement of your practice's actual claims;
- not a guarantee of any dollar amount you would recover or that Apex Flow could recover for you; and
- not an Apex Flow client result; Apex Flow does not publish client performance figures.
Your real, claim-level numbers are only produced when Apex Flow's engine analyzes your own claims as part of a free audit, which requires a signed BAA before any identifiable claim data is reviewed. Any figures, ranges, or "estimated exposure" values shown by the Site's tools are for general informational and illustrative purposes only.
4. Intellectual property
The Site's content, design, look-and-feel, brand elements (including the Apex Flow name and marks), and underlying code are the property of Apex Flow Revenue Cycle Solutions LLC or its licensors, and are protected by applicable intellectual-property laws. You may view and use the Site for your own informational purposes, but you may not copy, reproduce, distribute, modify, or create derivative works from the Site's content or code without our prior written permission, except as allowed by law (e.g., fair use) or as needed to use the Site normally in a web browser.
5. Acceptable use
When using the Site, you agree not to:
- submit false or fraudulent information through our forms;
- submit patient information, PHI, or other individually identifiable health information through the Site (see our Privacy Policy, Section 2);
- attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems;
- use automated means (bots, scrapers) to extract content from the Site outside of normal search-engine indexing; or
- use the Site for any unlawful purpose.
6. Disclaimers
THE SITE AND ITS CONTENT (INCLUDING THE FREE EXPOSURE-CHECK TOOL) ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any estimate, figure, or result shown on the Site will be accurate for your specific practice.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APEX FLOW REVENUE CYCLE SOLUTIONS LLC, ITS FOUNDER, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT EXCLUDABLE, OUR TOTAL AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED THE TOTAL FEES (IF ANY) YOU PAID TO APEX FLOW IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This limitation does not apply to, and does not attempt to limit, liability under a separately signed client services agreement or BAA, which will have its own terms.
8. Indemnification
You agree to indemnify and hold harmless Apex Flow Revenue Cycle Solutions LLC, its founder, members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Site in violation of these Terms; (b) information you submit through the Site (including any patient information submitted contrary to Section 5 above); or (c) your violation of any applicable law.
9. Governing law & disputes
These Terms, and any dispute arising out of or relating to the Site, are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding relating to the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
10. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
